Sale of alcohol by retail

The sale by retail of alcohol and the supply of alcohol by or on behalf of a club are both licensable activities. We mention sale and supply, Sales to the general public are sales by retail. Supply of alcohol is normally to a club member or guest.

Regulated entertainment

Regulated entertainment is broadly defined as any entertainment that takes place in the presence of an audience (whether members of the public or a club), or otherwise for profit, and the premises have the purpose of providing the entertaining concerned. It may include: 

  • a performance of a play
  • an exhibition of a film
  • an indoor sporting event
  • a boxing or wrestling entertainment
  • a performance of live music
  • playing of recorded music
  • a performance of dance
Impromptu games such as, darts or pool in a pub are not classed as regulated entertainment. 

Late night refreshment

Late night refreshment is the sale of hot food or drink to the public to consume off or on the premises) between 11pm and 5am.

Do i need a personal licence to serve alcohol?
A premise where alcohol is sold in the UK requires a premises licence. Every premises licence must have a personal licence holder named on the premises licence as the indivdual in charge of those licensed premises. In England and Wales this person is known as the Designated Premises Supervisor (DPS) and in Scotland the individual is know as the Premises Manager.

The Designated Premises Supervisor (DPS) or Premises Manager can authorise sales of alcohol under a premises licence, however there are some differences in law between England and Wales (licensing Act 2003) and Scotland (licensing Act Scotland 2005).

Licensing Act 2003 for England and Wales

Under the 2003 licensing Act every premises must have a Designated Premises Supervisor (DPS). The DPS must hold a personal alcohol licence. However a manatory conditions on a premises licence state the following;

Mandatory conditions where licence authorises supply of alcohol.

(1)Where a premises licence authorises the supply of alcohol, the licence must include the following conditions.

(2)The first condition is that no supply of alcohol may be made under the premises licence.

(a)at a time when there is no designated premises supervisor in respect of the premises licence, or .
(b)at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. .

(3)The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Letter of deligated authority

As it quite clearly states above every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. Some licensing authorities seem to allow this mandatory condition to be over looked by insisting on a letter of deligated authority. This is a letter signed by the designated premises supervisor that authorises named individuals to sell alcohol under their personal licence in their abcence. It is important to note there is no mention of a letter of deligated authority in the Act, therefore it is advisable to have several personal licence holders on a licensed premise to ensure the aforemention mandatory condition is adeared to.

What Licence do I need to run a pub?

Licence to run a pub

To run a pub (public house) you require a personal licence. A personal licence will allow you to sell alcohol by retail under a premises licence for a public house.

How to get your licence

To obtain a personal alcohol licence you are required to undertake a one day training course on the Licensing Act 2003 for England and Wales or if you are looking to run a pub in Scotland the Licensing Act (Scotland) 2005.

After you have completed your personal licence holders training you will need to take an examination on the relevant licensing Act. Exams are known as the Award for Personal Licence Holders (Level 2) or in Scotland the Scottish Certificate for Personal Licence Holders (Level 5).

APLH or SCPLH examinations consist of 40 multiple choice questions based on the licensing Act. You will learn all you need to know to pass the exam during your training. Once you have booked your course you will also receive a course handbook.

Applying for your pub licence

Once you have passed your exam you will receive a certificate of training. This certificate will allow you to apply to your local councils Licensing Authority or in Scotland licensing Board for your personal licence.

Fit and proper person?

Under the old licensing Act to run a pub you had to be a fit and proper person, in other words not have any relevant criminal convictions. Under the new Acts you still have to provide evidence of no relevant convictions. In England and Wales you must include an in-date CRB check certificate with your application and in Scotland the Police will undertake a PNC check on you when you make your application.

How long does a pub licence last?

A personal licence is valid for 10 years, however in Scotland there is a need for re-training every five years.

The pubs premises licence

Under both licensing Acts a pub (public house) also requires it's own licence. This is known as a "Premises Licence". A personal licence will enable the licensee to be nominated on to a Premises Licence as either a (Designated Premises Supervisor) - England & Wales, or a (Premises Manager) - Scotland. A premises can not operate legally without a Designated Premises Supervisor or Premises Manager.

What is a Designated Premises Supervisor/Premises Manager

Basically the Designated Premises Supervisor or Premises Manager (Scotland) is the individual named on the premises licence as the person responsible for the correct running of the licensed premises. A Designated Premises Supervisor or Premises Manager must give their written consent to be named on a premises licence and maybe accountable should the licence come in to contention.
