The Award for Personal Licence Holders will allow the holder to apply for a personal licence to sell alcohol.
The APLH level 2 Award replaces the old NCPLH licensing qualification and came into force on the 1st of April 2010. The Award for Personal Licence Holders will allow the holder to be become a Designated Premises Supervisor and be name on the premises licence as the Licensee or DPS for short.

On the 1st of October 2011 all licensed premises in Scotland are now required to operate a challenge policy.
This policy is Challenge 25

This simply means

Anyone who appears under the age of 25 should be challenged to prove their age when attempting to purchase alcohol or any other age restricted products

Section 6 of The Alcohol etc. (Scotland) Act 2010 introduces a new mandatory condition for all premises licences and occasional licences requiring that there must be an age verification policy in place in relation to the sale of alcohol on the premises. The section has set a minimum age of 25 years for the policy where it appears to the person selling the alcohol that the customer may be under the age of 25 years. Premises may set any minimum age for their own policy provided that it is 25 years or over.

Challenge 25 for Scotand

On the first of October 2011 a challenge policy was introduced in to the Scottish Licensing Act (2005)
It became law for all retail premises selling alcohol and age restricted products to operate a " Challenge 25 policy". The Act provides no guidance as to the wording of any Policy but the licence holder must have a Policy in place.

So what is Challenge 25? let us explain in simple terms!

Anyone who appears under the age of 25 should be challenged to prove their age when attempting to purchase alcohol or any other age restricted products

In verifying age, it is reasonable to presume that only the following documents will be satisfactory to comply with the verification policy:-

Passport; or
European Photocard Driving Licence; or
Proof of age card bearing a ‘PASS’ hologram.

We at alcohol licence.org would advise on the following forms of identification.

UK Driving Licence
UK Provisional Driving Licence
Valid Passport
Pass Hologram Identity Card (Young Scott Card) etc

If the above documentation is not produced on request then the Policy cannot be complied with and the sale of alcohol should be refused.

The Policy must be in place on or before Saturday 1 October 2011. A failure to comply with this mandatory condition will be a criminal offence in terms of the Licensing (Scotland) Act 2005 which could result in a fine and/or imprisonment. It could also result in a review of the Premises Licence resulting in suspension or revocation of the Licence.

Challenge 25 or Challenge 21 What is the best policy?

Deciding which is the best challenge policy for your business can be a difficult choice, however we advise that for high street retailers such as an off licence businesses or a mini market, challenge 25 is the best policy and one that is adopted by most of the big supermarket chains. Pubs and bars tend to stick with challenge 21 but not all in some areas many bars and pubs are now choosing to operate a challenge 25 policy.

So lets try and explain the difference! with challenge 21 you only have a 3 years between the age of 18 and 21, but with the challenge 25 policy the gap is 7 years, therefore staff are less likely to make a mistake when asking for proof of age. An unauthorised sale of alcohol to a trading standards test purchaser will lead to an on the spot fine for the person involved and an interview under caution at the local police station or trading standards office which may also then lead to a criminal prosecution in Magistrates Court.

The maximum fine under the licensing Act 2003 for selling alcohol to an underage person is currently £5,000
Another concideration for retailers to be aware of is Section 147A of the licensing Act 2003 "persistently selling alcohol to children"

Section 147A makes it an offence to sell alcohol to a child under 18 from the same premises on two or more occasions within a period of three consecutive months. The section applies to the person being responsible in relation to the premises at the time of each sale.

It should be noted that there is an alternative to criminal prosecution for the offence of persistently selling alcohol to children. Under section 169 A of the Licensing Act 2003, a closure notice may be given where there is evidence that an offence under section 147A is committed, there is considered to be a realistic prospect of conviction and the offender is still a holder of a premises licence in relation to the relevant premises. A closure notice shall propose a prohibition on sales of alcohol on the relevant premises not to exceed 48 hours. The form of a closure notice is prescribed in The Licensing Act 2003 (Persistent Selling of Alcohol to Children) (Prescribed Form of Closure Notice) Regulations 2007, which came into force on 3 May 2007.

A person guilty of an offence under this section is liable on summary conviction to a fine not exceeding level £10,000.

Mr Ravi of Personal Licence Training Ltd is leading a new campaign to deliver responsible alcohol retailing to members of the Tamil community. A landlord has been jailed for manslaughter after a man plunged to his death

A landlord has been jailed for manslaughter after a man plunged to his death through a cellar door and remained undiscovered for three days – because the bar owner was on a health and safety course.

James Teasdale, 36, who was on a night out with friends, could have mistaken the cellar door for the gents’ toilet, a court heard.

But today, in a rare case of gross negligence manslaughter, David Bell, 51, the landlord of Zest bar in Scarborough, was jailed for two years.

Leeds Crown Court heard that Bell had failed to lock the door, despite there being several occurrences of patrons mistaking it for a toilet or falling through it, resulting in injuries.

Ironically, Bell was away to attend course which would educate him on the risks to customers that his bar may pose the day after the accident which claimed Teasdale’s life.

He had already repeatedly postponed attending the course since he took over the lease.

Prosecuting, Jonathan Sharp told the court that careless Bell had taken over Zest bar in North Yorkshire, as landlord in July 2009.

Mr Sharp explained that a door leading down concrete steps to the cellar was situated directly off the area where the ladies’ and disabled toilets were, with just a note written on A4 paper saying ‘Private No Entry.’

Mr Sharp said: ‘This arrangement presented an obvious risk of fatal injury to visitors on the premises, and it was incumbent on the occupier of the premises… to assess the risk and then to take appropriate steps to minimise it.’

Bell had adequate warning of the danger the arrangement presented, starting with an incident which occurred just over a month after he took over the premises in August 2009.

Preventable death: Graphic designer James Teasdale, 36, fell to his death down a flight of stairs through a door that had been left unlocked by licensee David Bell

A young customer had been in the bar and went to the look for the toilets but mistook the cellar door for the gents’, finding himself plunging down the steps.

He hit his head, causing severe bleeding and permanent scarring, knocking himself out in the process. He managed to clamber back up before a paramedic was called and he was taken to hospital.

Bell admitted the situation with the cellar but made no attempt to correct it and didn’t even clean the blood off the steps.

There were also further incidents where a customer fell into the cellar while using a nearby cigarette machine, escaping with minor injuries, and another banged his head.

For a short period after these incidents, Bell had the door locked but then claimed the key was lost or stolen, leaving the hazard in place once again.

He did arrange for a new lock to be fitted, and it was due to be put in place the week after Mr Teasdale’s death.

On Sunday, July 11 last year, James finished work before joining friends for some drinks and got up to go to the toilet.

Mr Sharp said: ‘When he announced he was going to the gents’, one of his friends offered, in view of his state, to walk him there.

‘He, however, refused that offer and went alone. He did not return.’

Mr Teasdale either mistook the door for the gents’ toilet or fell through, tumbling down the stairs and banging his head on the basement floor.

He suffered substantial brain and head injuries as well as multiple other injuries to his body.

He remained conscious, but concussed, for between one and four hours after the fall and attempted to pull himself back up the stairs before crawling into another room in the cellar where he died.

His body was not discovered for another three days, until Wednesday, as the bar had been closed on Monday and Tuesday with Bell away on a health and safety course.

Mr Sharp said: ‘The freeholders of the premises had asked him (Bell) to go on a course as soon as he took over the lease but he had repeatedly postponed this.

‘As it happened he was booked to go on such a course the day after the fatal accident.’

After the premises were re-opened it was also discovered that there had been a spare key for the cellar door lock all along.

"What Training Do I Need to Run a Pub?"

Legally you need training on the current licensing laws so you can hold a personal licence which will allow you sell alcohol under the pubs premises licence. A personal licence will also allow the holder to be named on the premises licence as the designated premises supervisor or DPS as it is commonly known. To obtain a personal licence to work in England and Wales you will also be required to attend a one day training course for the Award for Personal licence Holders (APLH) Level 2 qualification. If you intend to run a pub in Scotland or Northern Ireland you will need to hold the reliant licensing qualification for that region. A pub company will normally hold the premises licence for the pub in their company name. Once you have obtained your personal licence your name can then be added to the premises licence as the Designated Premises supervisor (DPS). A premises can only sell alcohol under it's premises licence when there is a DPS named on the pub's licence. Selling alcohol with no DPS is subject to fine under the licensing Act 2003 and or 6 months imprisonment.

Example; Dragon Inns & Taverns Limited hold the premises licence for The Bull & Gate at Redditch in Worcestershire. The premises licence number is PLR/0071A. The premises licence was issued by Redditch Borough Council. The public house is currently closed and has no DPS on the the licence.

Mr Bill Smithfield from Bromsgrove is looking to become the new licensee or DPS. Bill is required to take a personal licence training course for his new licence to allow him to sell alcohol from the Bull & Gate if the pub company allow him to take over the premises as the new licensee or DPS. Once Bill has completed his licensing law course and completed a simple multiple-choice exam of 40 questions he will be given a certificate to say he has passed. Bill will also need to submit a basic criminal records bureau check with his APLH licensing certificate together with some signed photographs of himself endorsed by a Solicitors or a person with a reconsigned qualification. Because Bill lives in Bromsgrove he comes under Bromsgrove council for his personal licence. So he must submit his personal licence application to them, once his personal licence has been issued he then needs to inform the pub company so they can give his written consent in writing to be added to the premises licence.

Once the up-date licence has been received a Bill displays the licence summary at the premise he then can legally sell alcohol again from the Bull & Gate.

Premises Licence Reviews increase

The number of hospitality businesses having their alcohol licence reviewed has soared by 19 per cent over the past year, fuelled largely by requests from police.

Police requests have driven the number of alcohol licence reviews up 19 per cent

In the 12 months to 1 April 2011 1,334 alcohol licences were reviewed, up from 1,125 in the previous year, according to data collected by legal information provider Sweet Maxwell.

By contrast, just 675 reviews were conducted in 2007, meaning the figure has doubled in five years.

Police requests for licence reviews in the period increased by 32 per cent, from 610 in 2009 to 804 in 2010, accounting for 60 per cent of all reviews for the year.

That’s in contrast to the number of reviews ordered in 2010 by Trading Standards (216, down from 230), Environmental Health (126, down from 150) and local residents (117, up from 110).

The number of ‘fast-tracked’ requests from police, which are intended to tackle crime and disorder associated with premises under the Licensing Act 2003, also increased during the year, from 75 in 2008/09 to 152 in 2009/10, a rise of 103 per cent.

The majority of these requests lay in the North West of England (28 per cent) and London (19 per cent).

Revoked licences

However, despite the increase in licence reviews, the number of licences actually revoked fell to 151 (11 per cent of all reviews) from 154 the year before.

Phil Crier, partner and head of the licensing team at law firm Blake Lapthorn, said: “The police have definitely become more active users of their licensing review powers. It is now common practice for police forces to use these powers particularly when dealing with a busy town centre pub or club.

“Police are under enormous political pressure to deal with the anti-social behaviour and the side effects of binge drinking and they see launching a review as a good way of the concerns being taken seriously.

“Our experience is that the problems the police identify with a premises can normally be sorted out just by talking to the operators of the bar or club and without the need for a licence review. The vast majority of pub and bar operators are more than happy to take on any sensible suggestions from the police.

“Frequently the police use these powers to impose restrictions on a venue rather than to actually remove the premises’ licence and shut it down. For example the police might use the review to limit a bar’s opening hours.

“Police are increasingly asking premises to install internal CCTV to a higher standard and they can use the licence review as a route to achieving this.”

A review may only be conducted on the grounds of crime and disorder, for the protection of children, if the business is a public nuisance or poses a risk to public safety.

Crime and disorder is the most common reason for a review, accounting for 72 per cent of all licence reviews in 2009/10.

Both the APLH and SCPLH licensing law courses end with a simple multiple choice examination of 40 questions. This licensing law examination must be invigilated under examination conditions. All the professional training venues and hotels we use can accommodate quite exam conditions and adequate space for all candidates sitting examinations.

Online courses are fine but candidate are still required to visit an examination centre to take their APLH or SCPLH examination.

However Personal Licence Training do offer both a distance learning course and a e-learning course for the APLH (award for personal licence holders) course. Ofqual rules state that residential address's can not be used for examination purposes. Examination rooms must be quite, well lit and have no leading information displayed.

Public House License or Pub License is a license granted to a public house or pub, this is now known as a premises license under the 2003 licensing Act for England and Wales. If your looking to run a public house then you will not need a public house license but a personal license to alcohol by retail.

Normally a public house license will be held in the name of the Pub Company that owns the public house.
For example; if you where looking to take over a lease or a tenancy on a pub owned by Punch Taverns or Greene king then the public house license or premises license would belong to the Pub Company. To take over as the licensee or manager the Pub Company would expect you to hold a personal license which will allow you to sell alcohol by retail from the public house in question.

An individual can be granted a personal alcohol license this will allow them to become Licensee of a Pub (public house). A personal license will also allow the holder to authorise other members of staff that do not hold a personal license to sell alcohol.

An individual must also be named on a public house license or premises license as the DPS or Designated Premises Supervisor. This means this person then act as the licensee on the public house license and is responsible for the day to day control of the public house.

To become a personal license holder the cost for the full personal license is around £295.00. However this can achieved for less money if you are willing to do the whole of the application process yourself.

Do I have to have to hold a personal licence to work in a pub?

No one is required to hold a personal licence to work in any licensed premises in England and Wales other than the person who is the designated premises supervisor in respect of the premises licence. However every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence! This is a mandatory condition on every premises licence issued in England and Wales.
The way this mandatory condition is perceived is normally that a there must be a personal licence holder on the premises in the absent of the designated premises supervisor! We have found in our experience that different Licensing Authorities read this mandatory condition in different ways. Some Licensing Authorities will insist on a list to be displayed at the premises of authorised persons, others will insist on a premises having several personal licence holders. Licensing Committees tend to favor additional personal licence holders on a premises licence when granting after a licence hearing.
As a company specialising is licensing law we always practice Best Advice It is essential that a premises licence holder uses due diligence to avoid un-authorised sales of alcohol to minors.
We recommend that there should always be a personal licence holder on duty to authorise any sale of alcohol or any sale of any other age restricted product in respect of that licensed premise.

In Scotland the law states that anyone working behind a bar or sales counter must have a minimum of two hours training on Scottish licensing law. This includes any person working part time or full time, paid or un-paid. So in Scotland to work behind a bar you do require a certificate or proof of staff training.
A record of that training must also be kept at the premises by the Premises Manager.

Now we think this is a fabulous idea! well we would we are a training company for licensing laws, however sales of alcohol to minors are often made by members of staff who have received little or no training.
If you authorise an individual as a DPS or a personal licence holder to sell alcohol on your behalf, did you know that if that individual makes a mistake and sells alcohol to an underage test purchaser you to would be interviewed at the local police station or trading standards office under caution!

An un-authorised sale of alcohol to a minor could land you with an on the spot fine of £80.00.
In some Local Authority areas you can be prosecuted in a Magistrates Court, the maximum fine under the licensing Act 2003 is up to £5,000
In most Local Authority areas two failed test purchases within twelve months will lead to a review of the premises licence before the Licensing Committee. The Licensing Committee have the power to revoke a premises licence or suspend a premises licence for up to three months.

What is a premises licence review?

The Licensing Act 2003 (“the Act”) sets out a procedure whereby a responsible authority or interested party can may make an application to the Local Councils Licensing Authority for the review of a premises licence or club premises certificate because of a matter arising at the premises in connection with any of the four licensing objectives.

The protection of children from harm
The prevention of public nuisence
The prevention of crime and disorder
The promotion of public safety

In every case, the representation must relate to particular premises for which a licence or certificate is in force and must be relevant to the promotion of the licensing objectives.

The Statutory Guidance issued by the Secretary of State in accordance with the Act (“the Guidance”) considers that the procedures to allow a review of a licence represent a key protection for a community where problems associated with crime and disorder, public safety, public nuisance or the protection of children from harm are occurring.

It should be noted that the Guidance recognises that the promotion of the licensing objectives relies heavily on a partnership between licence holders, authorised persons, interested parties and responsible authorities in pursuit of common aims. It is considered good practice for authorised persons and responsible authorities to give licence holders early warning of their concerns about problems identified at the premises concerned and of the need for improvement. It is expected that a failure to respond to such warnings would lead to a decision to request a review.

Similarly, in the case of interested parties, consideration should be given to whether their concerns could be effectively dealt with outside of the formal review process. Such steps could include:

•Talking with the licence or certificate holder to establish whether there are any steps they may be willing to take to rectify the situation.
•Asking the Licensing Section to talk to the licence holder on your behalf.
•Ask your local MP or Councillor to speak to the licence holder on your behalf.
•Talking to the relevant “responsible authority” (e.g. public protection in relation to noise nuisance or the police in relation to crime and disorder) to establish whether there is other action that can be taken to resolve the problem.

Who can make an application for a review?

The Act specifies that only responsible authorities or interested parties may seek a review of a premises licence and in the case of club premises certificate, this will also include members of the club.

The responsible authorities are:

•The Chief Officer of Police
•The Fire Authority
•The local enforcement agency for the Health & Safety at Work etc Act 1974 (either the local authority in some cases or Health and Safety Executive for others)
•Environmental Health
•Trading Standards
•The Planning Authority
•Social Services.

Note: In relation to a vessel only, responsible authorities will include navigation authorities within the meaning of Section 221(1) of the Water Resources Act 1991 which are:

•The Environmental Agency, the British Waterways Board, and the Maritime and Coastguard Agency

Interested parties are defined as:

•A person living in the vicinity of the premises in question
•A body representing persons living in that vicinity
•A person involved in a business in the vicinity of the premises in question
•A body representing persons involved in such businesses
•A member of a relevant licensing authority

There is no clear definition of what “in the vicinity” means but the Guidance indicates that Licensing Authorities, when making a decision as to whether an individual or body qualifies as an interested party, may look at whether a party is likely to be directly affected by disorder or nuisance occurring or potentially occurring from either inside or immediately outside the premises for which an application is being made.

What are the licensing objectives?

•The prevention of crime and disorder

•Public safety

•The protection of children from harm

•The prevention of public nuisance

Note: The licensing objectives are of equal importance

How can an application for review be made?

Any applicant for the review of a premises licence or club premises certificate must fully complete the prescribed application form and send it to the Licensing Authority. On the same day as the application is served on the Licensing Authority, the applicant must send copies of the application to all of the responsible authorities and the holder of the licence or certificate.

What happens when an application is made?

The Licensing Authority must first consider whether the reasons for the review are relevant to one or more of the licensing objectives. Secondly, in the case of an application from an interested party, the Licensing Authority must be satisfied that the application is not frivolous, vexatious or repetitious.

As a general guide:

•Frivolous and vexatious

“Frivolous” or “vexatious” will bear their ordinary meaning. For example, the Licensing Authority might find the representations were vexatious if they arise because of disputes between rival businesses or frivolous if they clearly lacked seriousness.

•Repetitious

A “repetitious” representation is one that is identical or substantially similar to:

◦A ground for review in an earlier application, which has already been determined

◦Representations considered by the Licensing Authority when the premises licence was first granted

◦Representations made when the application for the licence was first made and were excluded because of the prior issue of a provisional statement

In addition to the above grounds, a reasonable interval has not elapsed since any earlier review or the grant of a licence.

The review process is not intended to be used simply as a second bite of the cherry following the failure of representations to persuade the Licensing Authority on earlier occasions. It is for the Licensing Authority to judge what should be regarded as a “reasonable interval” in these circumstances. However, the Guidance suggests that more than one review from an interested party should not be permitted within a period of twelve months on similar grounds, save in compelling circumstances (e.g. where new problems have arisen) or where it arises following a closure order.

What happens if the review application is considered relevant?

The Licensing Authority will make arrangements for the display of a notice of the application for review of the licence or certificate as follows:

•Depending on the circumstances, a notice shall be prominently displayed at, on or near the site of the premises so that it can conveniently be read from the exterior of the premises by the public;

•At the Local Council's office in a central and conspicuous place; and

•On the City Council’s Website

The notice is required to be displayed for a period of 28 days (or, in the case of a review following a closure order by the Police, 7 days), during which time, any responsible authority or interested party may make a representation concerning the application.

Where should representations be sent?

Any representations from an interested party or responsible authority must be in writing and include details of the party’s full name and address. They should be sent to:

The Licensing Manager

The relevent Council;s Licensing Authority where the premises is situated

Licensing Section of the council to where the review is to take place

Representations must be received by the Licensing Section no later than the last date specified in the notice, as the Act does not allow the Licensing Authority to consider late representations.

How is the application considered?

Copies of any representations received will be sent to the holder of the premises licence or club premises certificate in respect of which the application has been made and arrangements will be made for the Council’s Licensing Sub-Committee to hear the application and representations. Hearings will take place in public, although the Sub-Committee may, in certain instances, decide that it is in the best interest of the public to hold the hearings in private.

The details of all representations (including any interested parties’ names and addresses) will be included in a report that will be prepared by officers from the Licensing Section. These reports are public documents and the Council is required to publish them.

The applicant for the review, the holder of the licence or certificate, any responsible authorities and/or interested parties will be invited to attend the hearing. Any party to the proceedings will be able to be assisted or represented by any person at the hearing, regardless of whether or not that person is legally qualified. Personal licence training have a team of licensing experts who can help with licence reviews.

Details of the date and time of the hearing together with details of the procedures to be followed will be sent to all those involved at least 10 working days before the day of the hearing.

The applicant for review, any interested parties and responsible authorities must give notice to the Licensing Authority at least 5 working days before the start of the hearing stating:

•Whether they will attend the hearing in person
•Whether they will be represented by someone else (e.g. lawyer / councillor / MP)
•Whether you think a hearing is unnecessary (if, for example, parties have reached an agreement before the formal hearing)
•Any request for another person to attend the hearing, including how they may be able to assist the Licensing Authority in relation to the application.

Can an application or representations be withdrawn?

Yes, an application for review of a licence or any representations can be withdrawn by way of giving notice to the Licensing Section no later than 24 hours before the day of the hearing or in person on the day of the hearing.

What happens if I do not attend the hearing?

The Licensing Sub-Committee can still consider the application and any representations in the absence of any party.

What action is available to the Licensing Sub-Committee?

The Act sets out what steps the Sub-Committee can take in relation to an application for review of a premises licence or club premises certificate.

The Sub-Committee can either make a decision at the end of hearing or have up to a maximum of 5 days from the day of the hearing, or the last day of the hearing, to come to a decision.

Following consideration of the application, the Sub-Committee may:

•Decide that no action is necessary to promote the licensing objectives
•Modify or add conditions to the licence
•Exclude a licensable activity from the licence
•Remove the designated premises supervisor
•Suspend the licence for a period (not exceeding 3 months)
•Revoke the licence (revoking a premises licence would mean that the applicant could not re-apply for a period of five years)

What action can be taken if an applicant for review, licence holder, responsible authority or interested party is unhappy with the decision of the Licensing Sub-Committee?

If an applicant, licence holder, responsible authority or interested party is aggrieved by the decision of the Sub-Committee, they can appeal against the decision to Portsmouth Magistrates Court within 21 days of receiving written notification of the Sub-Committee’s decision.

Any persons faced with such action are advised to take professional advice prior to any formal proceedings.

What is a personal licence?

All you need to know about a personal license, how to obtain a personal license and what a personal license will enable you to do can be found on this web-document.

A personal license holder is a person who is licensed to sell alcohol by retail or able to give authorisation to others to sell alcohol by retail. A personal license holder may also apply to become the Designated Premises Supervisor or DPS as it is known.

The Licensing Act 2003 has established a regime for the granting of personal licenses to individuals to supply, or to authorise the sale or supply of alcohol under a premises license.

The personal license is separate from the license that authorises the premises to be used for the supply of alcohol. The licensing of individuals separately from the licensing of premises permits the movement of personal license holders from one premise to another, allowing greater flexibility. It ends the previous outdated 1964 Act where publicans were tied by licenses to the premises where they work. The 2003 licensing Act also provides the police, responsible authorities and licensing authorities with powers to deal with unscrupulous personal license holders.

The personal license relates only to the supply of alcohol under a premises license. An individual will not require a personal license for the other licensable activities, the provision of regulated entertainment or late night refreshment, or for the supply of alcohol under a club premises certificate or temporary event notice (although personal license holders will be able to give 50 temporary event notices each year instead of the limit of 5 for non-personal license holders). However a personal license holder is required to oversee the sale of alcohol under a temporary event notice.

A personal license does not authorise its holder to supply alcohol anywhere, but only from establishments with a premises license authorising the supply of alcohol in accordance with the premises license. An individual may hold only one personal license at any one time. A personal license holder may only be the Designated Premises Supervisor (DPS) of one premise at any one time.

All premises licenses authorising the supply of alcohol must have an identified personal license holder known as the designated premises supervisor. This ensures there is always one specified individual who can be readily identified at a premise where a premises license is in force. This person will usually be responsible for the day-to-day running of the premises. More than one individual at the licensed premises may hold a personal license, although it is not necessary for all staff to be licensed. But, all supplies of alcohol under a premises license must be made by or under the authority of a personal license holder.

A personal license is issued for ten years in the first instance and can be renewed on application for a further ten years if the license holder has not been convicted of any relevant or foreign offence. An individual’s personal license is normally issued by the local councils licensing authority where they reside.

Applicants for personal licenses will need to obtain an accredited qualification first. The aim of the qualification is to ensure that license holders are aware of licensing law and the wider social responsibilities attached to the sale of alcohol. Personal license qualification providers are accredited by the Secretary of State.

The licensing qualification for a personal license holder in England and Wales is known as the Award for personal license holders or APLH Level 2. Scotland has a different licensing system. The licensing(Scotland)Act 2005. The licensing qualification for a personal license holder in Scotland is known as the Scottish Certificate for Personal License Holders SCPLH Level 5.

Both licensing qualifications will allow the holder to apply for a personal license to sell alcohol by retail.

In England and Wales applicants for a personal license are also required to apply for a basic criminal record check. In Scotland the police will conduct a PNC check on each applicant and a police interview may be required.

How to apply for a personal license

Before applying for a personal license to sell alcohol by retail, the applicant must hold a relevant licensing qualification. In England and Wales this is known as a Award for Personal License Holders APLH Level 2 and in Scotland the licensing qualification is known as the Scottish Certificate for Personal License Holders (SCPLH) Level 5.

An application for a personal license must be made to the Licensing Authority (England & Wales) /Licensing Board (Scotland). Licensing Authorities/Licensing Boards are departments of local councils.

When applying for a personal license the applicant should apply; to the Licensing Authority/(Scotland)Licensing Board where they live.

When applying for a personal license you will need to complete the appropriate application forms. These are available on request from the Licensing Authority/Licensing Board .

In England & Wales these application forms can also be downloaded from the DCMS website. In Scotland the applications can be obtained from your local licensing board.

Please note that an applicant’s full name including all forenames must be given on all documents in connection with the personal license application.

The completed personal license application must be accompanied by the following:

2 photographs (passport size) – one must be signed by someone of some standing within the community i.e. solicitor, accountant, police office, doctor, teacher, invigilator, minister of religion, bank or building society official or civil servant;
The fee of £37.00 (Cheque’s should be made payable to “Your Local Council”);
A Disclosure of Convictions and Declaration (this should state whether or not any relevant or foreign offences have been committed, including full details, were applicable).

There are several accredited awarding bodies who offer the licensing qualification for England, Wales all of these licensing qualifications are accredited by the Secretary of State and acceptable to licensing authorities. The awarding bodies are as follows;

NCFE Level 2 Award for Personal License Holders (APLH);
EDI Level 2 Award for Personal License Holders (APLH);
HABC Level 2 Award for Personal License Holders (APLH);
BIIAB Level 2 Award for Personal License Holders (APLH);

Many of our clients ask how can they sell alcohol from their shop or mini market if they do not currently sell alcohol? As a company we specialise in preparing new alcohol licence applications for off licence premises. To become an off licence you firstly need to licence the shop or premises to for the sale of alcohol off and away from the premises, hence the term off licence or beer off. Under the old 1964 licensing Act there where both on licences, off licences or both. The tradition off licence only sold beer, wine and spirits plus normally crisps and confectionery. In more recent times many convenience stores. mini markets and supermarkets now sell alcohol off the premises (off licence). off licence licence or licences as they are some times refered to are now known as a premises licence or premise licence. all new off licence applications are now granted under the licensing Act 2003 in England and Wales. unlike under the old licensing law off licence hours are no longer restricted and applicants can now apply to trade for longer hours as long as the new off licence application does not undermine any of the four licensing objectives under the 2003 licensing Act. A new application for a new off license has to be submitted to the local councils licensing authority and all of the responsible authorities including the police within the council area where the proposed off licence is to be sited.

Off Licence History
Off-licence (sometimes known as off-sales, Offie or beer-off) is a term used in the United Kingdom and Ireland for a shop licensed to sell alcoholic beverages for consumption off the premises, as opposed to a bar or public house which is licensed for consumption at the point of sale (on-licence). The term also applies to the licence granted to the establishment itself.
Off-licences typically are specialist shops, convenience stores, parts of supermarkets, or attached to bars and pubs. Prices are usually substantially lower than in bars or pubs.

In the United Kingdom, the "off licence" status of a shop could once be used as a device to circumvent restrictive trading laws, particularly those concerning Sunday trading. Depending on local by-laws, shops might be either required to close at 12:00 once a week, or else not be allowed to trade in the evening. Shops with an off licence made their hours similar to those of public houses, opening during lunch hours and from early evening to the mandatory closing time, usually 22:30 or 23:00. The Sunday Trading Act 1994 altered the situation somewhat.

Now under the new licensing Act 2003 many off licence premises now trade from 07.00 until 00.00 hours 7 days a week with no restrictions on Sunday, Good Friday or Christmas Day some supermarkets and off licences are open 24 hours.

The police will normally play a big part in the granting of hours for a new off licence as each application must be considered by the police licensing officer for the local community. If he or she has concerns that the application may undermine one of the licensing objectives or lead to more anti-social behavior in a given area the the police licensing officer may make an objection to the hours applied for or object to the off licence application completely. This then would lead to a hearing before the local councils licensing committee, where the applicant, their representative and the police can voice their opinions. The final decision to grant or not grant the off licence application is made by the licensing committee at the hearing.

Applying for a premises licence

Applying for a new premises licence under the 2003 licensing Act is probably more complicated now than it ever was under the old 1964 licensing Act. Under the old 1964 licensing Act there were both an on premises licence and an off premises licence. some applications were known as part 4 licensees new premises licence application is not only submitted to the local council's licensing authority, but to all relevant responsible authorities within a given council area. This will normally include the chief of police for the local area, fire service, planning authority, child protection unit, trading standards, health authority, environmental health authority and in some areas the rivers authority. A premises licence application must address the four licensing objectives and how the business will promote them but must also meet with the approval of all the responsible authorities the premises licence application is submitted to.

The licensing objectives that must be covered by each new premises licence application are as follows;

The prevention of crime and disorder
Public safety
The prevention of public nuisance
The protection of children from harm

Undermining any of these licensing objectives could lead to a review of a premises licence before a licensing committee. A local authority licensing committee have the power to;

Revoke a premises licence (for up to five years)
Suspend a premises licence (for up to three months)
Remove the designated premises supervisor
Apply conditions to a premises licence

All new premises licence applications must state what licensing activities will be taking place on licensed premises and at what times these activities will take place.

Licensable activities are;

The sale of alcohol by retail
The supply of alcohol by a members club
The provision of regulated entertainment
The provision of late night refreshment (between the hours of 11pm – 5am)

Any premises selling alcohol by retail, providing any form of regulated entertainment or providing late night refreshment between the hours of 23.00 hours until 05.00 hours the following day will need to be licensed under the Licensing Act 2003. Late night refreshment is specified as the retail sale of hot food and hot drink.

A premises licences is issued by the local council where the premises is situated. all premises licence applications are issed and controlled by licensing authority within the area the premises is located. This generally covers businesses such as pubs, social clubs, members clubs, restaurants, night clubs, cafe's, cinemas, theaters, hotels, off licenses and late night food takeaways.

Any premises where alcohol is supplied under a premises licence must have a nominated designated premises supervisor (DPS). This is a person who should be in day-to-day control of the licensed premises. A DPS must be a personal licence holder but will not necessarily be the premises licence holder, although this may sometimes be the case. It is expected that they will be the main point of contact for the premises at all times for the council's licensing authority, the police, fire service and all responsible authorities within the geographical council area. The DPS should be contactable should any problems occur at the licensed premises.

Eligibility criteria for your premises licence application

Any of the following may apply for a premises licence:

anyone who operates a business in the premises to which the application relates

a recognised club

a charity

a health service body

a person who is registered under the Health and Social Care Act 2008 in relation to an independent hospital in England

a chief police officer of a force in England and Wales

anyone discharging a statutory function under Her Majesty's prerogative

a person from an educational institute

any other permitted person

Applicants must not be under 18 years of age.

Application process for a premises licence

Applications must be sent to the council for the area where the Licensed premises are located.

Applications must be made in a specific format and be accompanied by the required application fee. Premises licence application fees are based upon the rateable value of the premise to be licensed. Scale plans at 1:100 0r (1:150 if approved by the licensing authority) must be submitted with the application and show where alcohol is sold and consumed.

Each new premises licence application must be accompanied by a consent form signed by the proposed Designated Premises Supervisor.

For all new premises licence applications or full variations of a premises licence application an operating schedule promoting the four licensing objectives must be written and included as part of the application procedure.

An operating schedule will include details of:

The licensable activities taking place
The times when the activities will take place
Any other times when the premises will be open to the public
In the case of applicants who wish to have a limited licence, the period the licence is required for
Information in respect of the premises supervisor
Whether any alcohol that is to be sold is for consumption on or of the premises or both
The steps proposed to be taken to promote the licensing objectives
Any other relevant required information

For new, provisonal statements or full variation applications

Copies of the application form, including any relevant accompanying documents, must be sent to all the responsible authorities on the same day that the application is given to the licensing authority.

A notice of licence application must be displayed at the premises to be licensed for 28 consecutive days. The notice must be copied onto pale blue paper not less than A4 size. How ever this may vary from one local authority to another. The number of notices to be displayed is determined by the size of the premises.

A news paper advert must be placed in a suitable local news paper. The notice must be placed in the public notices section. It is recommended that the advertisement is not placed in the newspaper until the council's licensing authority has confirmed that the application including all the required information has been submitted in full and is correct.

To sell alcohol in England Wales or Scotland you require two types of licence

Personal Licence
Premises Licence

A personal licence will allow an individual to sell alcohol by retail or authorise others to sell alcohol under their supervision. A personal licence will also allow the individual licence holder to become the designated premises supervisor or DPS. This is the person named on the licence as the person in day to day control of a premise.

A premises licence will allow the premises to carry on licensing activities, theses activities are;

The sale of alcohol by retail
Provision of regulated entertainment
Late night refreshment (the sale of hot food & drink between the hours of 23.00 until 05.00 hours)
The supply of alcohol from a members club

Any of the above activities requires a premise licence. When alcohol is sold a personal licence holder is also required. A licensed premise selling alcohol must have a personal licence holder acting as DPS on the licence, in Scotland this person is known as the premises manager.

To obtain a premises licence an application must be made to the licensing authority or in Scotland the licensing board. Under-age drinkers are buying fake driving permits over the internet

Under-age drinkers are buying fake driving permits over the internet to get served in bars and off-licences.

Police and door staff have seized cards which can be bought online for £40 or less.

The most popular is the fake international driving permit which, at first glance, is similar to a genuine United Kingdom driving licence.

Police in Market Harborough were alerted to the fakes recently when several youngsters tried to get into clubs or buy alcohol.

Sergeant Pete Jelbert, of Harborough police, said: “It has become apparent that these fake IDs are freely available as ‘novelty’ items from various unscrupulous websites.

“We are concerned because on a busy Friday night in a local pub these cards may be accepted by door or bar staff.”

One off-licence manager in Market Harborough said teenagers were regularly attempting to buy drink using the permits.

Claire Middleton, of Bargain Booze in the High Street, said: “Fake ID is a real problem and I have instructed all my staff to be on the look out.

“The international driving permit is the favourite and very tricky to spot. It is identical to the latest UK driving licence save for the wording.

“We get them at least once a week. At the weekend I challenged one lad and attempted to confiscate the card. He got shirty so I informed the police instead.”

Police and bar staff in the town have managed to seize some cards.

Police Community Support Officer Rob Sleath, who polices the town’s pubs and clubs, said “The easy availability of these fake IDs is what is worrying. If these were presented to busy staff in a dimly-lit bar, problems could occur.”

He said possessing a fake ID was not an offence but it was illegal to use them as proof of age to buy alcohol.

One website offers a range of fake IDs. The cards are produced in Spain and mailed back to the customer.

Prices range from £10 for a proof of age or student card, to £40 for the fake international driving permit.

The problem of fake IDs bought over the internet surfaced in Leicester more than a year ago.

Kev Whelan, spokesman for Hinckley Pubwatch, said: “Members of our group have been alerted to them.”

Mr Whelan, who runs the Bar Vis-a-Vis, said: “They are very convincing and look like a driving licence at first glance. They are often used by 17-year-olds who are chancing their arm.”

He said: “To avoid doubt now, Hinckley Pubwatch members insist on UK driving licences or passports only.”

Police are asking people who know anyone using fake IDs to call police on 0116 222 2222 or Crimestoppers on 0800 555 111.

From the 1st August 2010, the NCPLH licensing qualification will be renamed the Level 2 Award for Personal Licence Holders (APLH). The change comes as a result of a strategy to simplify qualifications in a new framework.

The APLH will continue to be delivered as a one-day training course with a 40 question multiple-choice exam at the end of the days training..

Changes to policy designed to simplify qualifications resulted in the creation of 'OFQUAL' as the qualifications regulator, and a new Qualifications and Credit Framework (QCF) to replace National Database of Accredited Qualifications.

Once again personal licence training tries to stay ahead of the competition; we are currently developing a new series of websites and blogs to provide delegates up-dated information on the new (APLH) Personal Licence Holders Level 2 Award.

We also understand that some of the multiple choice questions from awarding bodies such as EDI have been up-dated and the terminology of the questions have been simplified. This should help candidate who struggle with English.

OFF licenses and pubs in Worcestershire have been found selling alcohol to children

Pubs still selling booze to kids – findings

Out of 34 off licences and 13 pubs visited by the county’s regulatory services team using child volunteers who look their true age, six sales occurred. Two were at off licenses in the Droitwich area while four occurred at two pubs in Redditch and two in Kidderminster.

In each case the sellers did not challenge the volunteers for identification or ask them their age. Investigations are now underway and offenders could be hit with a fine of up to £1,000.

Tracey Blanchard, Worcestershire’s fair trading officer, said it was “very alarming” that nearly a third of the pubs visited sold alcohol to the youngsters. “They should certainly have been challenged and at the very least asked for identification,” she said. “We will be continuing our investigations into underage sales across the county.”

The visits in the Wychavon, Redditch, Wyre Forest and Malvern Hills districts were carried out at premises targeted on the basis of information from the police and local intelligence.

Changes on licensing law for England & Wales

From April, irresponsible drink promotions and the dispensing of alcohol by one person directly into the mouth of another (“the dentist’s chair” is but one example) have been banned and the provision of free drinking water on licensed premises is required.

Banned “irresponsible drink promotions” are those which are “carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance or harm to children”.

Promotions such as “all you can drink for £10” are now illegal.

From October 1, it will become mandatory to have in place an age verification policy (for instance “challenge 25”) and to offer smaller size measures of alcohol (for instance 125ml glasses of wine).

A “responsible person” (defined as the premises licence holder, the designated premises supervisor, or a person authorised to sell alcohol) will be liable on conviction for breach of any of these conditions to a fine of up to £20,000 and/or six months imprisonment.

The conditions will be deemed to be entered on the premises licence and do not need to be printed on it to be effective. It is essential that these conditions are brought to the attention of all those working in the industry.

Looking further ahead, the Queen’s Speech in May made it clear that the Government would be looking carefully at the licensing regime introduced by the Licensing Act 2003 and that changes would be made.

The forthcoming Police Reform and Social Responsibility Bill will, in the words of the Home Secretary, “tackle the drink fuelled violence which is blighting many of our communities”.

The total costs to the tax payer of alcohol related crime and disorder is between £8billion and £13bn.

As a first step, the Home Office is consulting on “Rebalancing the Licensing Act”.

Proposals considered in the consultation paper include increasing powers to refuse or revoke licences, increasing licence fees both generally and also to pay for policing late night drinking, banning below cost sales, an overhaul of temporary event notices, revocation of licences for non payment of fees, extending the proximity criterion for residents representations and many others.

Contact your local Council Licensing department and request forms. Most councils will have a pack they can send with information to help you through the process. You need:

Application for a Premises Licence

Consent of a Premises Supervisor

Declaration

Certificate of Posting of Public Notice and the Public Notices (Notice of Application for Grant of premises licence)

You will need at least one Personal Licence Holder. They must be over 18 and be responsible with no relevant convictions. They have to be licensed with the local council in the area they live in. If there is no Personal Licence holder (for example if they leave your employ) you cannot sell alcohol so chose someone permanent or a couple of people. Contact their local council for the application forms Disclosure of Convictions and Application for a Personal Licence.

The Personal Licence Holder will need an APLH certificate (formally NCPLH) for England, and Wales or a SCPLH certificate for Scotland – (find a local course here). The course also covers the application process – which is really helpful. There’s a multi-choice exam at the end and results available within a week. Re-sits can be done easily without re-sitting the whole course. You can contact Personal Licence Training Ltd for more information. An online mock exam can be found here.

Form DP1 available from the Police. You will get a certificate back which will confirm that you do or don’t have convictions. (Alternatively you can ask the team at Personal Licence Training Ltd to do this for you)

You will need to supply two forms of identification with your request for the Police check. You will need two passport type photos for your Personal Licence. They will need certifying as a true likeness of you on the back by someone of standing as with a passport application. The Personal Licence Application will state exactly what is required.

Once you’ve collected all the info you need you can complete and send off your Personal Licence Application.

You need to mark the plans with fire escapes, toilets, kitchens and other relevant information as directed by the Premises License application form. If you don’t have plans you may have to contact your landlord who may charge you for this.

It’s a long form but not as bad as it looks. Photocopy the form first so that if you make a lot of mistakes you’ve got a spare copy. The main areas covered are business and people information, activities you want to do, opening times, how you operate (see the next step) and how you meet the four licensing objectives.

This section is best done on a separate document and attached to your application – you can then make corrections and change it without redoing the whole application. You need to simply spell out how your shop operates and how you will ensure that you meet the four licensing objectives (above), cover things like number of staff, training, age checks, security, health and safety

All premises must have a Premises Supervisor, who is also a Personal Licence Holder. They will be first point of contact if there’s any trouble. Once they’ve got their Personal Licence, they will need to complete the Consent of a Premises Supervisor form to show they agree to be nominated for the role. This form is sent off with the Premises Licence.

Talk to the Personal Licence Training Ltd Team about any points you are unsure about. Are there other licensed shops in the area who could read through your application for you or even the tutors from the licensing course?

You need to post copies of your application to a wide number of authorities to give them chance to object: Your local Police, Fire, Environmental Health, Planning, Social Services, Health & Safety Executive, Trading Standards are a good start. Your application pack will probably give you guidance and may even give you their addresses.

You need to put an advert in the local paper to announce you are applying for a Licence. Wording for the advert is usually provided with your application forms. Time your advert to be in the paper a few days (but no more than ten) after you post the application off.
Make sure you include everything – there’s usually a checklist. Cost is dependent on the rateable value of your business (and extra costs if there are more than 5,000 people on the premises at any time).

Fill in and stick up the Notice of Application for Grant of Premises Licence on a nearby lamp post. This has to stay up 28 days. When you eventually take it down you need to complete the final form and send it in to confirm you’ve had the Notice up.

Your local licensing team may contact you about you application for clarification if needed – but if there’s no objections you’ll be putting your first case of beer on the shelf in a few weeks.

There is an annual fee to pay to keep your licence.

These last for ten years – you will need to ensure that they are renewed at this time.

Today's Big Question ????

In England and Wales, should staff training for the sale of alcohol be compulsory ? In Scotland under the 2005 licensing Act it more or less is! The law in Scotland states anyone working part time, full time
paid or un-paid, behind a bar or retail sales counter must have a minimal of two hours training on the 16 criteria under the Licensing Act (2005) Scotland.

In Australia and in most US states responsible alcohol training for staff is compulsory!

Local Councils are set to review their statements of licensing policy in January 2011. I wonder how many will add conditions about staff training? Will this help reduce un-authorised sales to individuals under the age of 18?

APLH personal licence holder re-named from NCPLH

NCPLH qualification to be re-named

July 29th, 2010

From the 1st August 2010, the NCPLH licensing qualification will be renamed the Level 2 Award for Personal Licence Holders (APLH). The change comes as a result of a strategy to simplify qualifications in a new framework.

The APLH will continue to be delivered as a one-day training course with a 40 question multiple-choice exam at the end of the days training..

Changes to policy designed to simplify qualifications resulted in the creation of 'OFQUAL' as the qualifications regulator, and a new Qualifications and Credit Framework (QCF) to replace National Database of Accredited Qualifications.

Once again personal licence training tries to stay ahead of the competition; we are currently developing a new series of websites and blogs to provide delegates up-dated information on the new (APLH) Personal Licence Holders Level 2 Award.

We also understand that some of the multiple choice questions from awarding bodies such as EDI have been up-dated and the terminology of the questions have been simplified. This should help candidate who struggle with English.

Personal licence training in conjunction with it’s training partners and associates will continue to offer over 100 courses for the new APLH licensing qualification throughout England & Wales. The licensing qualification for Scotland will remain unchanged.

Our APLH personal licence holders course book and training course content is also set to be updated. To help avoid unauthorised sales to minors we have expanded our course contents to include identifying fake identification, how fake i.d cards are obtained and adopting a challenge 25 policy or challenge 21Policy - Which is better for the high street retailer?

Two Strike Rule

From December 2009

Yellow card for two Leicester city retailers, Personal licence training attended two hearings this week as Police and Trading Standards crack down on underage sales in the city. PLT was instructed to provide training and licence advice to both retailers. Both city retailers had to agree to new conditions being imposed on their licence. One more failed test purchase could mean the loss of their alcohol license’s, as Leicester operate a two strike rule- meaning two failed test purchases and you could face revocation of your licence.

Happy new year to all our customers, old and new. January proved an early start for our licensing department with two new premises licence applications being granted in the first week of the New Year, Mr A's Restaurant in Plumstead London and North Bound Service Station in Northants. The company also launched it's new web site for Lancashire & Blackpool and hope to expand it's operations in the North West of England. We are also working with CPL Training to develop and deliver a new range of E-Learning products for the hospitality industry; these should be going live in March 2010 and will be added to all of our websites.
